The short version
SundaySaturday is a learning tool for parents and guardians, and children use it only through the links and PINs you give them. AI can make mistakes, so please review and, where needed, edit every AI-generated quiz, answer, grade or learning path before you rely on it or share it with a child. You own what you create and upload, and you’re responsible for having the right to use it. Paid plans renew monthly until you cancel; cancelling stops the next renewal, and we don’t refund partial months unless the law requires it. Optional location and activity tracking happen only if you choose “Accept All” in the cookie banner. See our Privacy Policy.
This summary is for convenience only. The full text below is what applies.
Agreement to these Terms
SundaySaturday is a product of Braintoy Inc. (“Braintoy”, “we”, “us” or “our”), a corporation incorporated in Canada and headquartered in Calgary, Alberta. These Terms of Service (the “Terms”) govern your access to and use of the SundaySaturday websites (including sundaysaturday.com and app.sundaysaturday.com), web application, email and chat assistants, marketplace and related services (together, the “Service”).
By creating an account, ticking the box to accept these Terms, or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information. If you do not agree, do not use the Service.
Who may use the Service; your account
You must be at least the age of majority where you live (18 or 19 in most Canadian provinces) to create an account. If you add a child, you confirm that you are that child’s parent or legal guardian, or that you have their parent’s or guardian’s permission.
You agree to give accurate information, keep it up to date, and keep your sign-in details confidential. You are responsible for all activity under your account, including activity through Google or Microsoft sign-in and through emails sent from your registered email address. Tell us promptly at support@sundaysaturday.com if you believe your account has been compromised.
We may suspend or close an account if we reasonably believe the account holder is under the age of majority.
Children
SundaySaturday is designed for parents and guardians to support their children’s learning. Children do not create their own accounts. They take quizzes and view learning material through share links, notice boards and PINs that you create and choose to give them.
As the adult on the account, you:
- consent, on your child’s behalf, to us processing the information described in our Privacy Policy;
- decide what information about your child to enter, and should share only what is needed (a first name or nickname is enough);
- supervise your child’s use of the Service and of any content you share with them; and
- keep share links and PINs private. Anyone who has a link or PIN may be able to open the content.
You can review, correct or delete your child’s information at any time from your account, or by contacting us.
The Service and changes to it
The Service lets you create assessments and learning paths, track progress, share content with learners, and use AI features and assistants. We continually improve the Service and may add, change or remove features, plans or content, or suspend the Service for maintenance. Where a change materially reduces a paid feature you rely on, we will give you reasonable notice.
Features we label as “beta”, “preview” or similar are provided for evaluation and may be changed or withdrawn at any time.
AI-generated content: important limitations
The Service uses artificial intelligence, including models provided by third parties, to generate quizzes, questions, answers, explanations, learning paths, curriculum suggestions, feedback and grades (“AI Output”).
AI Output is generated automatically and may be inaccurate, incomplete, outdated, biased, or not aligned with your curriculum, grade level or educational standards. AI Output is an educational aid. It is not professional, academic, medical, psychological or other expert advice, and it does not replace the judgment of a parent, guardian or qualified educator. Curriculum, grade and standards labels are informational only.
You are responsible for reviewing, and where needed editing, all AI Output before you rely on it or share it with a child. The Service gives you tools to edit, regenerate and delete AI Output for this purpose.
Do not include sensitive personal information about a child (for example, health, disability or family circumstances) in prompts, uploads or messages to the assistants.
To the maximum extent permitted by applicable law, we are not responsible for decisions made, or results obtained, by relying on AI Output, and we do not guarantee any educational outcome, score or grade.
Your content
“Your Content” means anything you or your learners submit to the Service, such as prompts, quizzes, questions, answers, uploaded files, links, learning paths, notes, messages and reviews. As between you and us, you own Your Content. You may use the AI Output generated for you, subject to these Terms and the rights of others.
You grant us a worldwide, non-exclusive, royalty-free licence (which we may extend to the service providers who help us run the Service) to host, store, copy, process, adapt and display Your Content only as needed to operate, secure and improve the Service and to provide it to you (for example, using your prompt to generate a quiz, or showing a quiz to a learner you shared it with). This licence ends when you delete Your Content or your account, except for content you have already published or shared with others. If you publish content to the marketplace or share it publicly, this licence also covers showing it to the people you published or shared it with.
You confirm that you have all rights needed to submit Your Content, including any textbooks, worksheets or other material you upload or link to, and that it does not infringe anyone’s rights or break any law.
Acceptable use
You agree not to, and not to help anyone else to:
- use the Service for anything unlawful, harmful, fraudulent or deceptive;
- upload or share content that infringes intellectual property or privacy rights, or that is hateful, harassing, violent, sexually explicit, or otherwise inappropriate for children;
- collect or share another person’s or another child’s personal information without authority;
- impersonate anyone, or misrepresent your relationship with a child;
- circumvent credit limits, seat limits, rate limits, paywalls or security controls, or share an account to avoid paying for seats;
- attempt to manipulate the AI features to produce harmful content or to reveal system instructions, or use AI Output to build a competing product;
- scrape, crawl or bulk-download the Service, or reverse engineer it except where the law allows; or
- interfere with, overload or disrupt the Service, or introduce malware.
Email and chat assistants
You can ask our assistants to act on your account, for example by emailing chat@sundaysaturday.com or chatting in the app. We act on instructions that come from your registered email address or your signed-in session, and we treat them as coming from you. Keep your email account secure.
Some actions, such as removing a child, ask you to confirm first. Assistant replies may include AI Output and are subject to section 5. We may send you service emails about your account and, if you turn them on, progress reports. You can change report emails in your settings.
Marketplace
Where available, the marketplace lets users publish, browse, review and acquire learning resources. Listings are created by their sellers, who are responsible for their accuracy, for having the rights to publish them, and for any commitments they make. Reviews must be honest and based on genuine experience. We may remove listings or reviews that break these Terms.
Unless a listing says it is offered by SundaySaturday, we are not a party to transactions between users. Any paid listings are subject to the price and terms shown at the time of purchase.
Plans, AI credits and payments
You can use SundaySaturday on a free plan or a paid plan. Current prices, seat rules and AI credit allowances are shown on our Pricing page and at checkout. Payments are handled by our payment processor; we never see or store your full card number.
- Automatic renewal. Paid plans are billed in advance and renew automatically each billing period (monthly unless stated otherwise) at the then-current price, until you cancel.
- Cancellation. You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period, and you keep paid features until then.
- Refunds. Fees are non-refundable and we do not give refunds or credits for partial periods, unused seats or unused AI credits, except where required by applicable law.
- AI credits are a usage allowance, not money. They have no cash value, cannot be transferred, and reset on the schedule shown in the app (unused credits do not carry over).
- Price changes. We will tell you at least 30 days before a price change applies to your subscription. If you do not agree, you can cancel before it takes effect.
- Taxes and failed payments. Prices exclude applicable taxes unless stated. If a payment fails, we may retry it and move your account to the free plan until it is resolved.
- Promotions. Coupons and trials are subject to the terms shown when you redeem them and may be withdrawn at any time before redemption.
Privacy
Our Privacy Policy explains what personal information we collect, including information about children, how we use and share it, and your rights. It forms part of these Terms.
Third-party services
The Service relies on trusted third parties, for example for payments, sign-in with Google or Microsoft, email delivery, AI features and analytics. Your use of their services may also be subject to their terms. The Service may link to third-party websites or resources; we provide these for convenience, don’t endorse them, and are not responsible for their content or practices.
Our intellectual property and feedback
The Service, including its software, design, curriculum catalogue, text, graphics, logos and the SundaySaturday name, is owned by Braintoy Inc. or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial educational purposes under these Terms. Any feedback or suggestions you send us are non-confidential, and we may use them without obligation to you.
Copyright complaints
If you believe content on the Service infringes your copyright, email support@sundaysaturday.com with: the work you claim is infringed, where the content is on the Service (the URL), your contact details, and a statement that you are the owner or authorised to act for them. We will review the notice, may remove or disable the content, and will handle notices as required by Canada’s Copyright Act (including its notice-and-notice regime) and other applicable law.
Suspension, termination and account deletion
You may stop using the Service at any time and delete your account from your profile settings. Deleting your account permanently removes it and its associated data, as described in our Privacy Policy. Cancel any paid plan first.
We may suspend or close your account, or remove content, if you materially breach these Terms, if required by law, or to protect children, other users or the Service. Where reasonable, we will tell you why and give you a chance to fix the problem. Sections that by their nature should survive termination (including 5, 6, 18, 19, 20 and 21) will survive.
Disclaimers
To the maximum extent permitted by applicable law, the Service and all content, including AI Output, are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. SundaySaturday is a tool to support learning; it does not guarantee any educational result.
Limitation of liability
To the maximum extent permitted by applicable law, Braintoy Inc. and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or relating to the Service, AI Output, user content or these Terms, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, or for death or personal injury caused by negligence.
Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Braintoy Inc. and its affiliates, officers and employees from claims, losses and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your breach of these Terms or of anyone’s rights. We may take control of the defence of any such claim, in which case you agree to cooperate with us and not to settle it without our written consent.
Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Before starting any claim, please contact us at support@sundaysaturday.com so we can try to resolve the issue informally.
If we can’t resolve it, and to the extent the law allows, any dispute will be settled by binding arbitration in Calgary, Alberta, on an individual basis and not as part of a class or representative action. Either of us may instead bring an eligible claim in small claims court, or ask a court for an injunction to protect intellectual property or confidential information. Any matter that is not arbitrated will be heard by the courts located in Calgary, Alberta.
If you are a consumer, nothing in these Terms takes away rights you have under the mandatory consumer protection laws of the province, state or country where you live. Where those laws do not allow mandatory arbitration or class-action waivers (for example, for consumers in Alberta or Québec), those parts do not apply to you and you may bring proceedings in your local courts.
Changes to these Terms
We may update these Terms from time to time. The version and effective date at the top of this page show the current version. If we make a material change, we will notify you in the Service or by email before it takes effect, and we will ask you to review and accept the updated Terms the next time you sign in. If you do not accept them, you may stop using the Service and delete your account.
General
You agree that we may communicate with you electronically, by email or in the Service, and that these communications satisfy any requirement for written notice. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, it will be modified to the minimum extent needed to make it enforceable, and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms are written in English; any translation is for convenience only.
